Hi Everyone,

Long story short, I found out too late that I am in the middle of a spot delivery scam.
As it stands right now, the dealer has 2 sets of paperwork that include the Agreement to Purchase and the Retail Installment Sales Contract as well as the power of attorney doc.
The first set is my name only.  The second set has my and my wife's name on it.
I have not signed any loan contracts.

The general sales manager called me yesterday (after me having the car for 9 days) and said they got my loan approved through Chase Automotive.

I asked for an account number and he didn't have it.  I asked him if I called Chase and gave them my name and info, would they know who I am...and he said no because the "paperwork is being processed...they wouldn't have your name yet"

I have now secured the money to purchase the car in cash (loan through my job).

Over the phone, the general sales manager said he would accept the cashier's check for the amount we agreed on and "everything would be finalized."

So my question is...is there any way that the dealership can still hold me to the loan agreement?

All I have is a verbal agreement he would accept the cash ...while he still has 2 sets of paperwork with me (stupidly) agreeing to a loan.

What kind of documentation should I ask for to make sure that the car is actually mine and I don't owe them anything else nor am I liable for any loan?

Thanks!!!!!

If you pay it off in cash/cashiers check you will not be held to a the loan. There is no pre-payment penalty on a loan from a big back like Chase anyway.  However, if the loan from your job is a bank or credit union loan.  The dealership is required by law to list your employer's financial source as the lien holder.  If it is just a personal loan from your job then just bring in the Check.  I sort of went through the same thing when i bought my car. It is not a dealership scam.  the dealer had to have some sort of financial instrument to cash if they delivered the car to you.  I emailed the guys at hoopdi.com for help any they helped me quite a bit.
