Hello,
I sold my car (Audi A4 1997) last week and now I have a problem with the buyer. Could anyone please advise me on my stand in the following situation.
I left the car at the buyer's place on Saturday. The car has been MD inspected and I drove it that day to the seller's home. No problems with the car at all, no problems with the car recently. The car was even inspected by another mechanic (at Audi dealership) by other interested buyer and the mechanic said the car was in a great shape for its age. The buyer test drove the car and liked it.
Now the buyer is calling me saying that the car won't start. According to the buyer the car has not been moved until Thursday when they tried to start it and it had problems. They want me to take the car back and return the money. Or at least cover the entire repair. Otherwise they threaten to seek legal action.
Should I be worried about their threats? I do not think I made any wrong doing, I disclosed all the problems with the car (the only problem was a minor coolant leak, less than an ounce a week, everything else was perfect when I signed the title to them). I am also sure there were no problems when I drove the car to their place or earlier. I feel sorry for the buyer who had this problem, but I think I should not be liable for any problems that occurred after I signed the title. After all, this is 12 year old car and occasional problems happen, they were just unlucky for something to die while the car was parked in their lot.
I appreciate your advice on this. Vladimir

this was a private sale.... right.... they can so a small claims action.... but they have to have proof... do you have copys of the inspection records... get them.... it could be they left a light on... or the battery terminal corroded...
be sure that if they file a action against you... that you request copys of the repair bills.... then go to the shop and talk to the mechanics and service writers... ask for towing receipts... talk to the tow truck driver...
get all of these peoples names... get them to appear in court... get your mechanic to show up also...
get a car fax report.....today... and again.. in a few weeks...
dig out all your receipts...
some people are really pains... i got a friend a job painting a condo interior.,., the plaster had a light texture to it... down one hallway... there looked to be a dark spot in the paint... it was a shadow... as the light was a long ways down the hall... they complained and complained... i had to take a flash light to show them its a shadow.. so some people just don't have a clue... i hope that you had the transmission serviced. prior to sale...
other people are just morons...... another short term customer... bought a used volvo... the person who sold it to them... had it completely serviced prior to sale... told him... you don't have to do a thing to the car... so they did nothing... for 4 years... not even change the oil... at 65 in the car pool lane.. the rods tried to leave the block one day... but the guy i bought if from told me i don't have to do anything to it... some people just don't have a clue...

Hi Wayne,
Thanks for your time and the advice.
It is a private sale so everyone says I should be OK. As you describe it, if they file a small claims court I will have to lose a lot of my time. However, I just do not wish to pay for repairs on the car which worked when I sold it. If they sue I'll push it to the end.
I do not think these people are stupid, it could be that they were just unlucky or did something to the car in the first five days and now wish to represent that as a problem that was present all time long.
