Moving Violations: New Laws for Drivers
Cell Phones Prohibits a person from driving a school bus or transit vehicle while talking on a cell phone. The law provides exemptions for emergency or work-related purposes. Hybrid Car Pool Lanes Pending approval of the federal government, the law would authorize certain low emission and hybrid vehicles to use the High Occupancy Vehicle (HOV) lanes without the usual minimum number of passengers. The vehicle must display a special decal, issued by the DMV. Headlight Use Requires drivers to turn on their headlights whenever driving conditions require the use of windshield wipers or when weather conditions limit visibility to less than 1000 feet. The use of parking lights or day running lights alone does not constitute compliance with the law. Motorized Scooters Requires the driver of motorized scooter to have a valid driver’s license or learner’s permit. The law also makes it illegal to change or remove the muffler to make the engine noise louder. From a distance of 50 feet, the scooter may be no louder than 80 decibels, a level of noise similar to a ringing telephone or doorbell. DUI Increases the period of time that drunk driving convictions remain on a driver's record from seven to ten years. Smog Fees Owners of cars six years old or less will not have to pay for smog tests. The current waiver only lasts for the first four years. The annual smog abatement fee will double from $6 to $12. High Occupancy Toll Lanes Authorizes test programs in Alameda, Santa Clara and San Diego Counties. Allows the driver of a vehicle without requisite number of passengers to use car pool lane in exchange for a toll. Military DMV Fees The DMV will be required to waive penalties for late payment of vehicle registration fees for members of the armed forces or National Guard on active duty, provided that the member of the military renews the registration within 60 days of returning home.
