YES I think so. People WAIT until they are in the car to make calls, and there's no way they are paying attention to the road. They slow down or speed up drastically and suddently appear drunk. We're "good" at driving, but not that good.

No. Eating food while driving should be banned since several polls indicate that is the number one distraction.

every morning I see people pulling out of their driveway on the phone. You just got in your car, who are you calling that it can't wait? I know people think head sets are the answer, but I think the real question is why are we constantly on the phone. People walk around the supermarket on the phone. Are you that insecure that you need a buddy holding your hand while your getting your Cheerios?
A friend and I were waiting outside Claim jumper one night, and this jackhole had his headset on while he was waiting with his friends and his family. People wear them like jewelry now. My firend leans over to me and says, "You know, I work with the number one neurosurgeon in the state and he never walks around with a headset on, I wonder what that guy must do that is so critical that he needs to be able to take a call at any second?"
I hate people!!

haha. i was driving past a new M5 with some tasteful mods, and was wondering why on earth he was driving so damn slow. sure enough a young blond popped up from time to time. the guy didnt even have tinted windows, lol.
but a little back on topic - it depends on the driver. sure 90% of people are morons on the phone, but earpieces and speaker phones should still be alright.

Should it be illegal to talk on your phone in CA? Yes, but is there a realistic possibility of it being enforced, NO. There is no way for law enforcement to stop cell phone usage while driving. If cell phones were banned, all cars would have integrated phones. How does an officer know if you're just singing to the radio or having a phone conversation. Its too late, californians are spoiled. Privileges become rights.

it should be illegal but never is never going to be. i find the best way not to get annoyed by people on there phones while driving is to make sure you're going faster than them...and for that matter everyone else on the road, or cut them off, at least it makes them get off their phone...at least for a second...but anyways people talking on cell phones while driving rank up there with the worst drivers right next to drunk/sleepy, really old, and idiots(wait that might be redundant)...

lol.. thats what i was thinking the whole time..
it shouldnt be completely illegal, no one is doing that. even in states where it has been outlawed, you are still permitted to use hands free kits/ headsets.

OK after reading all these replies:
1. Yeah who NEEDS to be talking so much? Maybe I need more friends or something... 2. You're right, it can't be enforced, but that's the case with most laws. Car pool lane, speeding... most traffic laws are hard to enforce, but we still have them. It is a deterrent though. 3. If you can't fight it, join it. Make it your goal to be on the phone MORE; the entire commute home if possible. Then you don't notice all the OTHERS who are doing it cuz you are too. Just an idea. 4. Headphones, earpieces...you're still distracted right? And it's flat out disturbing to see someone arguing alone in a car. That's distracting to other drivers. ;-) again just a thought. 5. As for the M5 - that takes it on the distraction scale. 6. No food in cars, no makeup in cars... we do all this and then are shocked when we crash.... duh.....

I have admit I'm one of those idiots on the road that drive really dangerously when I'm talking on my cellphone lol.
