Update: Class Action Suit

We had our preliminary meetings with the Class Action Litigation Team at our lawfirm and it does in fact appear that we have something here.

Anyone who has purchased a Nissan or Infiniti product within the United States and Canada, will be eligible to be added to the class action. We have both US and Canadian based attorneys/lawyers.

The amount of evidence we have against them in overwhelming...I'm talking about being turned away for service, being cursed at by the dealer principal, being slandered ,etc.... These guys are going down bigtime... It would be my absolute pleasure to assist any of you in getting in on this class action.

I will post an email for anyone who wishes to proceed.

Thanks!

I am in the same boat as many others on the 02 oil burning Altima and am looking for a way to have Nissan fess up and take responsibility for a poorly made and designed vehicle. Please post any other info pertaining to the potential class action against Nissan.

Go infiniti_g_35!  I am 100% behind this issue.

I have a 2002 Nissan Maxima with the exact same story as everyone else.  100-120K is when I started to notice the oil burning issue.  Currently at 130K and using at least a quart every 1000 miles.

Please keep the information flowing on this case.  If you need help please post what we can do.

Thanks.

Last week, the engine on my 2002 Altima 2.5s finally bit the dust.  It had been consuming a lot of oil since 60,000 miles and it got progressively worse to the point where I was putting in 1 quart of oil for every 300 miles. I had the catalytic converter (& O2 sensors) replaced at 120k miles, but at 137k miles, it plugged up again and I wasn't able to drive over 10 miles an hour. I limped to the closest mechanic, they told me that I had 25% compression in only 1 cylinder and were amazed that the car even made it to their shop. Now I'm looking at replacing the engine & catalytic converter, approx $4,500. Doesn't make sense to do it, because the book value of the car is only in the $4k-$6k range. I can't justify fixing the car, only to potentially have the same problem occur (based upon other peoples experiences on this forum.) So, now what do I do?  I have a big boat anchor!  Do I store it in my garage, keeping it, pending the possible class action lawsuit that user "infiniti_g_23" was mentioning?  Or, do I just bring it to the junkyard and put this behind me.  I'm going to call Nissan and see what they have to say. I'm not expecting any positive actions, but at least I want them to know whats going on.

Even though the Altima was a fantastic car and I really liked all aspects of the car, I'll never by a Nissan product again.

It sounds like we are having the same problem as everyone else here.  We have been going back and forth with our local dealership since April of 2007 with no real success.  The keep telling us that they can't identify a problem and to bring it back in every 1000 miles to have the oil level checked.  Our warranty expires in March of 2008 and I had the feeling that they were just buying their time until then and after reading all of these posts I am SURE that this is what they are doing.  I would definitely appreciate any further information that anyone has to offer regarding a class action lawsuit or any other suggestions.  I definitely think that I will start getting more aggressive with Nissan in my approach from now on.
Thanks.

I was just told like some of the other 02 Nissan owners that I need a new engine, the cost $4500.00 for starters.  Nissan really needs to take responsibilty for what is happening.  Please post any other information pretaining to the class action against Nissan. Thanks.

Yesterday (11/26) a new recall was announced.  Does this fix our problem?  Is it related?  It sounds like it could be, but they certainly don't mention replacing the engine, only reprogramming some software module.  I called my dealer but they said the campaign does not start until December 10th, 2007.  Sounds related, I did a google news search on it.

And seriously, it seems that people want in on the class action suit.  Who is leading this initiative and what is the right way to get on board?

It seems to me that this is a pretty common problem with the Altima. Mine has less than 85,000 miles and the dealer advised me that Nissan doesn't do head gasket repairs - they just replace the engine. Well, the quote I received was over $5200.00! I have a mechanically inclined son who has experience working on cars, so I chose to buy the parts and have him do the work (slave labor works). The car is almost finished and I've only spent about $1000.00. I called Nissan Consumer Affairs to complain because there is no way a head gasket should fail at only 85,000. Someone is supposed to contact me by end of business today. I'll let you all know what comes of it.

I forgot to say that the catalytic convertor on my Altima had to be replaced too. The cat is attached directly to the manifold and when it fails, particles of grit are sucked back into the cylinders causing additional problems of scoring the walls. So we had to do the rings and cylinders, too.

The recall that just came out today is for the crankshaft sensor, I don't know how that plays into my problem - I know that I had a previous recall repair for the crankshaft sensor in April 2004.

I just had this problem on my 2002 Nissan Altima.  It has about 136k miles on it.  I was at my parents' home for Thanksgiving, about 3.5 hours from my home, and my car would not start.  We had the car towed to the local Nissan dealership and they told me my catalytic converter came apart, the engine overheated, and I had no oil.  They said I would need a new engine to the tune of $4600.

I decided it'd be worthwhile to get a second opinion.  My father knows the owner of the Chevy dealership in town so we had it towed there next.  They determined that my exhaust system was clogged, which had caused the engine to overheat.  According to the compression tests on the engine (with and without the exhaust system connected), everything looked good and there was no need to replace the engine.  They advised me to replace the exhaust system "front to back" for $1600 total.  I'll probably have it done.  I mentioned the possibility of using after-market parts and ditching the precat in the hopes of avoiding a recurrence of this problem, but the mechanic said he could not guarantee that I would pass my state's (GA) emissions inspections if I went that route.

Can someone please tell me how to get in on the lawsuit. I had the exact same pre cat/engine failure issue in March 07. I just replaced the transmission in Oct 07.

Please contact me at stacieandrick@yahoo.com. I want in!

I have a 98 altima with 89,000 miles.  Took it in for its 90,000 check up (it gets regular oil changes and is well taken care of).  As well, we just noticed a little leaking -- we thought transmission fluid.  the garage said is is the head gasket that needs replacing.  We got a second opinion from a mechanic/friend and he concurs.  He also said the rating on the Nissan Altima Engine for 98 is below average/poor.

If there is a class action suit for this repair, we would be interested in joining it.  Thanks
